It is not illegal to make moonshine in the US if you pay the appropriate taxes to do so. According to the rules of the Alcohol and Tobacco Tax and Trade Bureau, you need to fill up the proper paperwork to have your distilled spirits plant approved for operation.
Believe it or not, these distilleries are actually making moonshine legally, thus proving that you can make moonshine without being jailed or fined.

Dawsonville Moonshine Distillery
This distillery is situated in the same location as Georgia’s Racing Hall of Fame. It is also in the same vicinity as the City Hall of Dawsonville. So far, it has sold its first ever batch of liquor for the Mountain Moonshine Festival.
Cheryl Wood, the distillery owner, worked hard to fulfill the legal requirements to operate a distillery. The planning and actual acquisition of permits took months. She also had to resign from the phone company she was working in to go full time in alcohol distilling. She similarly had to borrow money. Now, all her sweat, toil and tears are paying off.
Her business is currently using a 250-gallon moonshine copper still, 415-gallon stainless steel mash as well as a 1,050 gallon steel mash.

Their product is called Thunderbeast Storm Moonshine. Mad Buffalo Distillery’s CEO, Chris Burnette, comes from a long line of farmers and homesteaders who distilled grain for survival. Similarly, moonshine was a staple in his home when growing up.
He proudly states that his moonshine recipe comes from local ingredients and are directly from corn that has been milled, grown, processed, malted, fermented from Missouri’s Shawnee Bend Farms.
Overall, illegally distilling alcohol is considered a felony in the United States. Under state laws, it is a must that the appropriate permits are acquired prior to alcohol distillation.
